WORKERS' COMPENSATION
If you are injured during the course or scope of your work day, then your injury is considered work-related. Some injuries are even work related if they occur away from the employees work site, provided that you have been injured while engaged in work duties. Occupational diseases may also be covered by Workers Compensation Law.
If a business has more than three employees, then that business is required by law to obtain workers' compensation insurance.
When you file a workers' compensation claim, you are simply requesting the benefits that are due to you. There may also be an opportunity for you to settle your case. However, there is no requirement that an employer must settle your case with you and he may or may not choose to do so.
What you can expect after your injury is weekly checks and medical care. If you find that you are not getting weekly checks in the right amount or if you medical care is lacking, an attorney can help make sure your rights are protected. Further, it does not matter if you are at fault or not in regard to the accident. Either way, you still are covered by workers' compensation benefits.
